1. Acceptance of Terms
By accessing, installing, browsing, or utilizing the Scalable platform, APIs, academic schedule generators, or faculty portals (“Services”), you, individually and on behalf of the university, college, school district, or institution (“Institution”) you represent, acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (“Agreement”).
If you are executing this Agreement on behalf of an educational institution, you warrant and represent that you possess the requisite legal and institutional authority to bind such entity to all terms set forth herein.
2. Services & Constraint Satisfaction Engine
Scalable provides an intelligent Constraint Satisfaction Problem (CSP) solving engine designed to synthesize conflict-free academic timetables, balance faculty teaching hours, manage classroom and lab allocations, and distribute institutional curriculum requirements.
- Hard-constraint verification: Zero room over-allocation, zero teacher double-booking, and zero student cohort overlaps.
- Soft-constraint optimization: Teacher preferences, pedagogical pause distribution, and campus travel minimization.
- Bidirectional synchronization with Student Information Systems (SIS) and timetable publishing APIs.
3. Account Security & Multi-Factor Authentication
Faculty members, department heads, and academic administrators are provided access based on assigned Role-Based Access Control (RBAC) tiers. You are responsible for preserving the confidentiality of login credentials.
In compliance with institutional security requirements, Multi-Factor Authentication (MFA) via Time-Based One-Time Password (TOTP) or hardware security keys is required for all administrative roles with schedule publishing or grade record-keeping permissions. Any suspected security incident or unauthorized credential compromise must be reported immediately to Scalable Security Operations.
4. Student Privacy & Regulatory Compliance (FERPA & GDPR)
Scalable is engineered with strict privacy-by-design principles. We recognize the sensitive nature of educational records and student scheduling data:
- FERPA Compliance (US): Scalable acts as a “School Official” with legitimate educational interests under 34 CFR § 99.31(a)(1). Student data is never commercialized, rented, or mined for external advertising purposes.
- GDPR & Data Residency (EU): All personal data processed within European jurisdictions is hosted on ISO 27001-certified regional infrastructure with end-to-end encryption in transit (TLS 1.3) and at rest (AES-256).
5. Institutional Data Ownership & Portability
The Institution retains exclusive and unconditional ownership of all student rosters, curriculum structures, faculty directories, room inventories, and generated timetables inputted or created within the platform.
Scalable guarantees full data portability. Administrators may export schedules, conflict logs, and workload matrices at any point in open formats (including iCalendar / ICS, CSV, and structured JSON) without proprietary lock-in.
6. Computational Solvers & Service Level Agreement (SLA)
Scalable commits to providing a 99.9% uptime SLA for timetable viewing and faculty access portals during active academic terms.
For automated CSP schedule generation, computation time is contingent upon model complexity (e.g., number of overlapping cohorts, room capacity limits, and teacher unavailability windows). The engine employs parallelized branch-and-bound optimization designed to produce optimal or near-optimal solutions within minutes for typical institutional sizes.
7. Acceptable Use Policy
Users agree not to: (a) reverse engineer, decompile, or disassemble the CSP solver algorithms; (b) conduct unauthorized penetration testing or denial-of-service simulations without written consent; (c) upload malicious scripts, payloads, or unverified automated scraping agents; or (d) bypass RBAC authentication checks.
8. Limitation of Liability & Disclaimers
Except as expressly stated in a custom Enterprise Master Services Agreement, the Services are provided on an “AS IS” and “AS AVAILABLE” basis. While the CSP solver guarantees mathematical constraint satisfaction against the rules supplied by the Institution, the Institution is solely responsible for verifying the accuracy and completeness of input data (such as classroom capacities and faculty contract limits).
To the maximum extent permitted by applicable law, in no event shall Scalable Systems Inc. be liable for any indirect, incidental, special, consequential, or punitive damages arising from timetable modifications or room conflicts stemming from faulty institutional input data.
